1. About these terms

These Terms of Service (“Terms”) govern your use of the CA Mart website and services provided by [CA Mart] (“CA Mart,” “we,” “us”). By using our site or buying from us, you agree to these Terms. If you don’t agree, please don’t use the site.

2. Who can use CA Mart

You must be at least 18 years old, or the age of majority in your province, to make a purchase or sell a device to us. By using the site, you confirm you meet this requirement.

3. Accounts

You’re responsible for keeping your account details and password confidential and for anything that happens under your account. Let us know right away if you think your account has been used without your permission.

4. Products and pricing

We do our best to describe products accurately and show correct pricing, but errors happen. If we discover a pricing or description error after you’ve placed an order, we may cancel the order and refund you in full. Prices are in Canadian dollars unless stated otherwise and don’t include applicable taxes and shipping.

5. Orders

Placing an order is an offer to buy. We accept your offer when we send an order confirmation. We may refuse or cancel any order for reasons including limited stock, suspected fraud, or an obvious pricing error.

6. Shipping and pickup

Shipping times are estimates and may vary depending on destination, carrier availability and other factors outside our control. Customers are responsible for providing accurate shipping information at checkout. Orders may also be made available for pickup where that option is offered. Nothing in these Terms limits any rights or remedies available to you under applicable consumer protection law.

7. Certified pre-owned devices

Pre-owned devices sold by CA Mart are tested, inspected and graded before being offered for sale. Because these devices are not new, normal cosmetic wear may be present depending on their condition or grade. Where applicable, devices may also be checked against available lost or stolen device databases before being listed. Product-specific condition, warranty and other relevant information will be provided with the device or applicable listing.

8. Repairs

By submitting a device for repair, you confirm that you own the device or are authorized to approve work on it. CA Mart may inspect and diagnose the device before confirming the recommended repair and price.

Where additional damage or work is discovered after inspection, we may contact you for approval before proceeding with additional chargeable work.

Customers should back up important information before leaving a device for repair whenever possible. Repairs involving damaged storage, software or internal components may carry a risk of data loss. CA Mart does not intentionally access personal content unless access is reasonably necessary to diagnose, repair or test the device.

Repair timing and availability of parts may vary depending on the device, issue and required components.

9. Sell or trade-in

Quotes for devices submitted for sale or trade-in are estimates based on the information provided before inspection. Final value is determined after CA Mart physically inspects and verifies the device, including its model, condition, functionality and other relevant factors.

If the device materially differs from the information originally provided, CA Mart may revise the offer. You will have an opportunity to accept or decline a revised offer before ownership is transferred. Customers should back up their data, sign out of accounts and remove personal information before transferring a device to CA Mart.

10. Warranty and returns

Returns, exchanges and any CA Mart warranty coverage are subject to the applicable Return Policy and warranty terms provided with the product or service. Eligibility may vary depending on the product, condition, reason for return and other applicable requirements.

Nothing in these Terms or any CA Mart policy limits rights or remedies that cannot lawfully be excluded under applicable Canadian or Ontario consumer protection law.

11. Your responsibilities

You agree not to use the site for anything unlawful, to impersonate anyone, to interfere with the site’s operation, or to try to access parts of it you aren’t authorized to. We may suspend or close accounts that break these rules.

12. Intellectual property

All content on the CA Mart site (logos, text, images, layout) belongs to CA Mart or our licensors and is protected by law. You may not copy, reproduce, or use it commercially without our written permission.

13. Limitation of liability

To the maximum extent permitted by applicable law, CA Mart will not be liable for indirect, incidental, special or consequential losses arising from use of our website, products or services.

Nothing in these Terms excludes or limits any liability, warranty, remedy or consumer right that cannot legally be excluded or limited under applicable law.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the site with a new effective date. Continuing to use the site after changes means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Any dispute will be handled in accordance with applicable law and the jurisdiction of the courts having authority over the matter.
